Acceptance of Terms
By accessing or using the Build My Presence website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or engage our services. We reserve the right to update these terms at any time, and continued use of our services constitutes acceptance of any changes.
Services
Build My Presence provides digital marketing, web design, branding, app development, content creation, social media management, and search engine optimization services for businesses. The specific scope, deliverables, and timelines for each engagement are outlined in individual project proposals or service agreements provided to clients prior to commencement of work.
Payment Terms
Payment terms vary by engagement type. Project-based work requires a deposit before work begins, with remaining payments due at agreed-upon milestones or upon project completion. Recurring services such as social media management or ongoing SEO are billed monthly. All payment schedules, amounts, and methods are detailed in the applicable service agreement. Late payments may result in suspension of services.
Intellectual Property
Upon full payment, clients own the final deliverables produced for their project, including website designs, brand assets, and content. Build My Presence retains the right to display completed work in our portfolio, case studies, and marketing materials unless otherwise agreed in writing. Third-party assets such as stock photography or licensed fonts remain subject to their respective license terms.
Client Responsibilities
Clients are responsible for providing necessary content, materials, and information in a timely manner. This includes text, images, brand guidelines, account credentials, and any other assets required for the project. Clients are also responsible for providing timely feedback during review stages, supplying accurate business information, and ensuring they have the rights to any materials provided to us.
Limitation of Liability
Build My Presence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability for any claim related to our services shall not exceed the amount paid by the client for the specific service giving rise to the claim. We do not guarantee specific results such as search engine rankings, traffic volumes, or conversion rates.
Termination
Either party may terminate recurring service agreements with 30 days' written notice. Project-based engagements are governed by the terms outlined in the project agreement. Upon termination, the client is responsible for payment of all work completed up to the termination date. We will provide reasonable assistance in transitioning services to another provider upon request.
Governing Law
These Terms of Service are governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the use of our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with standard commercial arbitration rules.
